1. Legal Identity and Agreement

1.1 These Terms of Service constitute an agreement within the meaning of Articles 6:213 through 6:248 of the Dutch Civil Code between the user and:

1.2 These terms apply to all Resqueu services, including Digital services as referred to in Articles 6:230g through 6:230z of the Dutch Civil Code.

1.3 Resqueu is not an emergency service, a control room, a medical service provider, a safety authority, or a party legally designated as an emergency call service. Resqueu does not perform any function as referred to in the Telecommunications Act or the Safety Regions Act.

1.4 If any provision of these terms and conditions proves to be invalid, all other provisions remain fully in force pursuant to Article 3:41 of the Dutch Civil Code.

2. Applicability and Acceptance

2.1 These terms and conditions apply to all use of the Resqueu app by consumers, including installation, registration, access, use of free features, and use of paid features.

2.2 By downloading, installing, opening, or using the app, the user accepts these terms and conditions in accordance with Article 6:232 of the Dutch Civil Code.

2.3 If the user does not agree to these terms, they may not use the app.

2.4 These terms constitute a binding agreement as soon as the user opens the app.

3. Definitions

For the purposes of these terms, the following definitions apply.

3.1 App
The Resqueu mobile application, including the software, interface, features, APIs, servers, systems, databases, algorithms, notifications, and all components necessary for the app's functioning.

3.2 User
Any natural person who installs, opens, or uses the Resqueu app.

3.3 Account
The user's personal registration within the app. The account may consist of identification data, permissions, settings, groups, contacts, and other data.

3.4 Premium
The paid features of Resqueu that become available after subscribing through Stripe.

3.5 Inner Circle
The group of people selected by the user to receive location data and SOS notifications.

3.6 Location Data
All information related to the user's geographic position, such as GPS coordinates, Wi-Fi signals, cell tower locations, movement information, accuracy estimates, and any data derived from these. Location data is personal data as defined in Article 4 of the GDPR.

3.7 SOS Function
The function in the app that allows the user to send an emergency signal. This function is intended solely as a communication tool and is not a replacement for 112 or any other emergency service.

3.8 KYC
The identification check that Resqueu may perform for the purposes of fraud prevention, security, verification, and compliance with legal obligations.

3.9 Force Majeure
Situations as defined in Article 6:75 of the Dutch Civil Code in which Resqueu cannot be held liable for fulfilling its obligations.

3.10 Digital Service
A service provided to the user in digital form, as defined in Articles 6:230g through 6:230z of the Dutch Civil Code.

4. Modification of these terms and conditions

4.1 Resqueu may amend or supplement these terms and conditions in accordance with Article 6:237(c) of the Dutch Civil Code.

4.2 Amendments will be announced in a timely manner via the app or via the user's contact information, if available.

4.3 Amended terms and conditions are deemed accepted by continued use of the app after the effective date.

4.4 If the user does not agree to a change, they must immediately stop using the app.

5. Technical requirements and system responsibility

5.1 The user is responsible for ensuring a suitable and compatible device, sufficient storage space, internet connection, battery capacity, location settings, permissions, and all technical requirements necessary to use the app.

5.2 Resqueu is not liable for damage caused by device settings, operating system limitations, blocked background processes, Android or iOS limitations, data loss, network interruptions, or issues caused by mobile providers.

5.3 The user acknowledges that digital services are dependent on external factors such as network providers, third-party servers, cloud platforms, and operating systems.

5.4 Resqueu cannot guarantee that all functions will work on every device or operating system or model work completely or consistently.

6. Minors and Parental Supervision

6.1 Minors under the age of sixteen may only use the app with the permission of a parent or legal guardian as defined in Article 7 of the General Data Protection Regulation and Article 1, 2, 3, 4 of the Dutch Civil Code.

6.2 The parent or legal guardian who gives consent represents and warrants that he or she:

  • consents to the minor's use of the app
  • consents to the sharing and processing of the minor's location data
  • fully supervises the minor's use of the app
  • manages all settings, privacy options, SOS options, and group settings for the minor
  • is responsible for all actions the minor performs within the app.
  • is responsible for any payments or subscriptions activated within the minor's account.
  • is liable for any damage the minor causes within the app pursuant to Articles 6 and 6/9 of the Dutch Civil Code.

6.3 Resqueu reserves the right to request proof of parental consent at any time if we deem it necessary.

6.4 If there are any doubts about the child's safety, the accuracy of parental consent, or in the event of abuse or violation of these terms, Resqueu may suspend or terminate the minor's account pursuant to Article 6 and 6/8, paragraph 2 of the Dutch Civil Code.

6.5 Resqueu is not liable for damage caused by a parent's lack of supervision, incorrect settings, insufficient monitoring, or insufficient understanding of the app's functions.

7. SOS function and emergency communication

7.1 Not an emergency service
Resqueu's SOS function is solely a communication function and does not replace official emergency numbers or emergency services. Resqueu is not a control room, medical service, emergency service, or safety authority as defined in the Telecommunications Act or the Safety Regions Act.

7.2 Operating Conditions
The SOS function depends on several external factors, such as internet connection, server response, battery status, device settings, notification permissions, correct contact configuration, and recipient reachability. Functionality cannot be guaranteed.

7.3 No Warranty
Resqueu does not guarantee that:

  • SOS notifications will be sent
  • SOS notifications will be received
  • SOS notifications will arrive on time
  • assistance will be provided
  • contacts will respond
  • the location will be displayed correctly during an emergency
  • an SOS notification will function under all circumstances

7.4 Exclusion of Liability in Emergency Situations
Resqueu is not liable for damage resulting from:

  • death
  • personal injury
  • Missing
  • Incorrect location data
  • Failed SOS notifications
  • Delayed SOS notifications
  • Incorrectly configured contacts
  • Technical limitations of the device or network
  • Blocked background processes
  • Lack of reception by contacts

This exclusion is permitted under Article 675 of the Civil Code and Article 623p, paragraph 2, on digital services.

7.5 Obligation to call the emergency number
In the event of an actual emergency, the user is obligated to immediately call the national emergency number. The user may never rely on Resqueu's SOS function as the sole means of communication during an emergency.

8. Location Services and Background Tracking

8.1 Legal Basis
Location data is processed based on:

  • User consent as referred to in Article 6(1)(a) of the GDPR
  • Necessity for the performance of the service as referred to in Article 6(1)(b) of the GDPR
  • Legal obligations where applicable

8.2 Types of Location Data
Resqueu may process the following information:

  • GPS coordinates
  • Wi-Fi data
  • Cell tower signals
  • Movement and sensor data
  • Accuracy parameters
  • Data generated by the device itself

8.3 Consent to Background Tracking
The user consents to the automatic processing of location data as long as the app is active or the user has background location enabled on the device. The user is responsible for correctly setting this consent.

8.4 No Guarantees
Resqueu does not guarantee that:

  • Location is always accurate is
  • location is always available
  • app syncs correctly
  • location under all conditions are correctly updated.
  • Location functionality is the same on all devices or operating systems.

8.5 Influence of device and operating system
Tracking can be affected by battery optimization, energy-saving modes, Android or iOS limitations, Wi-Fi strength, GPS conditions, and other factors beyond our control. Resqueu is not liable for any resulting damages.

9. Inner Circle and group functions

9.1 The user has complete control over which people are added to their Inner Circle. The user is responsible for managing, removing, and configuring these members.

9.2 Resqueu is not responsible for incorrect or unwanted access to location data if the user adds people themselves, fails to remove them, or chooses incorrect settings.

9.3 The user must act with due care when sharing location data and must comply with the due care standard of Articles 6 and 6 of the Dutch Civil Code.

9.4 Resqueu may restrict groups or access to functions in the event of:

  • misuse
  • Stalking
  • Intimidation
  • Threatening situations
  • Violation of law or terms

10. Messages and Communication

10.1 The user may not send messages that are threatening, intimidating, discriminatory, sexually offensive, hurtful, unlawful, fraudulent, or misleading. These behaviors fall under various provisions of the Dutch Criminal Code, such as Articles one, three, seven, c, one, three, seven, d, two, eight, five, and two, eight, five, b.

10.2 Resqueu may delete, block, or restrict messages if they violate these terms or the law.

10.3 The user is fully responsible for all content they send, pursuant to Articles six, one, six, two of the Dutch Civil Code.

11. Prohibited Use

The user may not use Resqueu for:

  • Stalking as defined in Article two, eight, five, b of the Dutch Criminal Code
  • Threats as defined in Article two, eight, five, c. Identity fraud as defined in Articles 2 and 3 of the Dutch Criminal Code
  • Hacking or breaking into accounts as defined in Articles 1, 3, and 8 of the Dutch Criminal Code
  • Tracking individuals without permission
  • Abuse of the SOS function
  • Manipulation of location data
  • Fraud
  • Activities that violate the law or public order

Resqueu has the right to immediately terminate accounts if these provisions are violated.

12. Technical limitations and risks

12.1 Digital services depend on devices, servers, networks, and software. Resqueu cannot guarantee that the app will always function uninterruptedly or error-free.

12.2 Resqueu is not liable for:

  • Data loss
  • Incorrect location data
  • Missed SOS notifications
  • Server outages
  • Network interruptions
  • Deficiencies caused by third parties
  • Limitations of mobile operating systems

13. Privacy and Data Protection

13.1 Resqueu processes personal data in accordance with the General Data Protection Regulation and the GDPR Implementation Act.

13.2 Personal data includes, but is not limited to: account information, location data, device data, communication data, settings, usage data, and data derived from app activity.

13.3 Processing takes place on the basis of:

  • user consent
  • necessity for the performance of the agreement
  • legal obligation
  • legitimate interest to the extent permitted by the GDPR

13.4 Consent can be withdrawn. Withdrawal is not retroactive.

13.5 Resqueu does not process special categories of personal data unless this is legally permitted and necessary for the service.

13.6 Resqueu does not retain personal data longer than is necessary for the purpose of processing or to comply with statutory retention periods.

14. Categories of Personal Data

14.1 Resqueu processes the following categories of data:

  • Account information such as name, phone number, and verification status
  • Location data such as GPS data, network data, movement information, and accuracy estimates
  • Device data such as device model, operating system, settings, and unique identifiers
  • Communication data within the app
  • Usage data, log files, and interaction data
  • Data of contacts within the Inner Circle or groups added by the user

15. Processing Purposes

15.1 Data is processed for the following purposes:

  • Providing the app services
  • Functioning the SOS function
  • Functioning the Inner Circle
  • Sending notifications
  • Account management
  • Fraud prevention
  • Technical support
  • Security and misuse prevention
  • Compliance with legal obligations

15.2 Location data is used for SOS, Inner Circle, recommendations, and technical analysis.

16. Location data

16.1 Location data is processed when the user has given permission. Provided via the operating system or app settings.

16.2 Location data may be processed when the app is active or when background location is enabled on the device.

16.3 Location accuracy may vary. Resqueu does not guarantee complete accuracy.

17. User Rights

17.1 The user has the following rights under the GDPR:

  • right of access
  • right of rectification
  • right of erasure
  • right to restriction of processing
  • right to portability
  • right to object
  • right to withdraw consent

17.2 Requests will be executed within the statutory timeframes.

18. Security of Personal Data

18.1 Resqueu takes appropriate technical and organizational measures to protect personal data against unauthorized access, loss, destruction, or alteration.

18.2 Security measures may include encryption, access control, logging, and secure storage.

19. Subprocessors and Transfer

19.1 Resqueu may engage external service providers for hosting, storage, payments, and technical infrastructure. These parties are considered subprocessors under the GDPR.

19.2 Subprocessors process data solely on Resqueu's instructions.

19.3 Data may be transferred to countries outside the European Economic Area when appropriate safeguards are in place, such as standard contractual clauses.

20. Retention Periods

20.1 Personal data will be retained for as long as necessary for:

  • performance of the agreement
  • statutory retention periods
  • security and fraud prevention

20.2 Location data may be retained for a shorter period if technically necessary.

21. KYC Identification Check

21.1 Resqueu may perform KYC to verify identity for security, fraud prevention, or compliance with legal obligations.

21.2 The User is obligated to provide correct information during KYC.

21.3 Insufficient, incorrect, or fraudulent KYC information may lead to account suspension or termination.

22. Misuse and Security Incidents

22.1 Resqueu may restrict or terminate accounts in the event of:

  • data misuse
  • unlawful processing
  • security breach
  • fraud
  • attempted access to other people's data

22.2 Security incidents will be reported to competent supervisory authorities when required under the GDPR.

23. Complaints

23.1 Users can submit complaints about data processing to the Dutch Data Protection Authority.

24. Subscriptions and Payment Structure

24.1 Resqueu offers paid Premium services on a subscription basis. The user can activate these services through the app.

24.2 Payments are processed through Stripe. The user agrees to Stripe's terms and conditions when making a payment.

24.3 By activating a subscription, the user enters into a distance contract as defined in Articles 6:230m through 6:230z of the Dutch Civil Code.

24.4 Premium features are activated immediately after successful payment.

24.5 All subscriptions are automatically renewed until the user cancels them via the app.

24.6 Resqueu may change subscription prices. The user will be notified of this in advance. Continued use constitutes acceptance of changes.

25. Automatic Renewal

25.1 Subscriptions automatically renew at the same rate each billing period, unless announced in advance.

25.2 If direct debit fails, access to Premium may be temporarily blocked.

25.3 Resqueu may retry payment collection within a reasonable period.

26. Termination of Subscriptions by User

26.1 The user can terminate the subscription at any time via the app.

26.2 Termination will take effect at the end of the current billing period. Premium access will remain active until that date.

26.3 After termination, the standard account will be retained unless the user deletes their account.

27. Right of Withdrawal

27.1 Pursuant to Article 6:230p, paragraph d, subparagraph one, no right of withdrawal applies to digital services that are made immediately accessible and for which the user agrees in advance to immediate delivery and waives the right of withdrawal.

27.2 By activating Premium, the user agrees to this, and the right to cancel expires once the services are made available.

27.3 Resqueu does not offer refunds once services have already been activated.

28. Refunds

28.1 Premium services are non-refundable after they have been activated.

28.2 In exceptional cases, Resqueu may, at its sole discretion (but is not obligated to), offer partial or full compensation in the event of a technical problem directly attributable to Resqueu.

28.3 Technical problems caused by device settings, network issues, or user error are not eligible for refunds or compensation.

29. Suspension and Termination by Resqueu

29.1 Resqueu may suspend or terminate accounts or subscriptions if:

  • the account is misused
  • fraud is suspected
  • payment is not made
  • the user violates the terms
  • the safety of others is jeopardized
  • underage users do not have parental consent

29.2 Resqueu may delete accounts for prolonged inactivity, as permitted under the GDPR.

29.3 For serious violations, Resqueu may terminate Premium without refund.

30. Payment Processing

30.1 All payments are processed securely through Stripe. Resqueu does not store full payment information.

30.2 Stripe processes payments in accordance with its own terms and privacy requirements. The user is responsible for reviewing these terms.

31. Billing

31.1 Invoices are automatically generated through Stripe.

31.2 The user is responsible for providing accurate billing information.

31.3 If billing information is missing or incorrect, Resqueu cannot adjust invoices retroactively.

32. Taxes

32.1 Applicable taxes may be added to the subscription price in accordance with Dutch law.

32.2 The user agrees that taxes will be automatically charged.

33. Financial Restrictions

33.1 Resqueu may restrict certain features or access if the user misuses payment methods or receives chargebacks.

33.2 Unfounded chargebacks will result in permanent account termination.

34. Limitation of Liability

34.1 Resqueu is not liable for any damages resulting from the use of the app, except in cases of intent or gross negligence on the part of Resqueu.

34.2 Resqueu is not liable for:

  • Delay or failure of SOS notifications
  • Incorrect location data
  • Loss, personal injury, or death
  • Data loss
  • Incorrect settings by the user
  • Blocked background processes
  • Actions or neglect of Inner Circle members
  • Network interruptions or server failures
  • Damage due to app updates or system limitations
  • Damage caused by third parties or subcontractors

34.3 To the extent liability cannot be fully excluded, Resqueu's total liability is limited to the amount paid by the user in the twelve months preceding the damage event.

34.4 Resqueu is not liable if damage is due to force majeure as defined in Articles six and seventy-five of the Dutch Civil Code.

35. No warranties

35.1 The app is provided "as is."

35.2 Resqueu does not guarantee that:

  • the app will always function fully
  • there will be no interruptions
  • all functions will be available on all devices
  • All data is processed correctly
  • The app is suitable for a specific purpose

35.3 The user remains responsible for the security of their device and its settings.

36. Indemnification

36.1 The user indemnifies Resqueu against all third-party claims arising from the user's use of the app, including but not limited to:

  • misuse of location data
  • stalking
  • intimidation
  • unlawful processing of data of others
  • violation of third-party rights
  • incorrectly setting the Inner Circle

36.2 This indemnity also applies to legal costs.

37. Account Termination

37.1 The user can delete the account at any time via the app.

37.2 Resqueu may terminate an account if:

  • the user violates the terms and conditions
  • misuse is detected
  • fraud occurs
  • legislation is violated
  • the safety of others is jeopardized
  • Parental consent is missing for minors
  • there is harassment or abuse

37.3 Termination of an account will not result in a refund of costs unless legally required.

38. Force Majeure

38.1 Resqueu is not obligated to fulfill obligations in the event of force majeure as defined in Articles six and seventy-five of the Dutch Civil Code.

38.2 Force majeure includes, but is not limited to:

  • network outages
  • power outages
  • third-party outages
  • internet interruptions
  • cyberattacks
  • natural disasters
  • pandemics
  • technical limitations within operating systems

38.3 During force majeure, obligations are suspended or limited.

39. Changes to the Services

39.1 Resqueu may change, remove, or add features without prior notice, to the extent permitted by law.

39.2 Resqueu may temporarily or permanently discontinue the app.

39.3 The user is not entitled to compensation if features are changed or discontinued.

40. Changes to these terms

40.1 Resqueu may change these terms.

40.2 Changes will take effect as soon as they are displayed in the app.

40.3 If the user continues to use the app, the change will be deemed valid. Deemed to have been accepted.

41. Applicable law

41.1 These terms and conditions are exclusively governed by Dutch law.

41.2 Disputes will be submitted to the competent court in The Hague.
